Effective October 7, 2026 · Version 2026-10-07.2
Applies to: the Premier Staff candidate application portal, accessible at app.premierstaff.com and apply.eventstaff.ai (the "RecruitGenie" platform, together with any related pages, forms, and messaging, the "Platform").
"Premier Staff," "we," "us," and "our" mean Premier Staff.
"You" and "Candidate" mean the individual who accesses the Platform to apply for event-staffing work.
Effective date: October 7, 2026 | Version: 2026-10-07.2, Section 4.7 clarified (previous version 2026-07-03, effective July 3, 2026)
By submitting an application through the Platform, you agree to these Terms of Service (the "Terms") and to our Candidate Privacy Policy, which is incorporated into these Terms by reference. Please read both documents before you apply.
How acceptance is recorded (clickwrap). Before you submit your application, you must affirmatively indicate agreement — by checking an unchecked "I agree" box presented next to conspicuous links to these Terms and the Privacy Policy — and then click submit. At the moment you submit, we record:
We keep that acceptance record for as long as we retain your candidate file, so that both you and we can establish exactly which version of these Terms you agreed to and when.
If you do not agree to these Terms and the Privacy Policy, do not check the box, do not submit an application, and do not otherwise use the Platform.
By submitting an application, you represent and warrant that:
We may decline, close, or remove any application that we reasonably believe does not meet these requirements.
Premier Staff is an event-staffing agency. The Platform lets you apply for staffing positions, verify your contact information, complete a recorded video interview, and be considered for placement into shifts and jobs with our business clients — event brands, venues, and producers (our "Clients").
The application process includes some or all of the following steps:
How your information is collected, used, shared, and retained is described in full in the Candidate Privacy Policy.
This section grants Premier Staff broad rights in what you submit. Please read it carefully.
4.1 Your Submissions. "Submissions" means everything you provide through the Platform, including your video interview recording, its audio, the transcript, any resume you provide, and your application data (name, contact details, city, position, and related responses), together with materials derived from them (such as transcripts, AI-generated scores, summaries, and recruiter notes).
4.2 License grant. You grant Premier Staff a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable, and sublicensable license to host, store, reproduce, display, transmit, analyze (including by automated and AI/machine-learning systems), create derivative works from (such as transcripts, scores, and summaries of), and share with our Clients your Submissions, in each case for the following purposes:
4.3 You keep ownership. You retain ownership of your Submissions. This license does not transfer ownership to Premier Staff; it gives us the rights described above so that we can operate the Platform and our staffing business.
4.4 Sharing with Clients. You specifically acknowledge and agree that, to place you into work, Premier Staff shares your candidate profile — which may include your video, transcript, AI-generated scores, and application data — with prospective Clients. Clients may use that information to decide whether to offer you a shift or role. Our Clients' own use of your information is subject to their practices, as described in the Privacy Policy.
4.5 Statutory-rights carve-out. Notwithstanding the words "perpetual" and "irrevocable" above, if you exercise a valid deletion or similar right under applicable data-protection law (such as the CCPA/CPRA or, in Mexico, the LFPDPPP) and we honor that request as described in the Privacy Policy, we will cease using and will delete the affected Submissions, except to the extent retention or continued use is permitted or required by law (for example, for legal compliance, dispute resolution, or completed-placement records). This carve-out reconciles the license with your statutory rights; it does not narrow the license for Submissions you have not asked us to delete.
4.6 Survival. The license in this Section 4 survives any termination of these Terms or closure of your candidacy, subject to Section 4.5 and the retention practices described in the Privacy Policy.
4.7 Instant Matching (optional). Beyond the purposes in Section 4.2, we use your Submissions to match you to other open positions as they open and to train and improve our own matching and evaluation models only if you turn on Instant Matching on the application form. When it is off, your Submissions are used only for the positions you applied for. You can turn it off at any time by emailing support@premierstaff.com; that stops matching and future training use right away and does not affect models already trained with de-identified data. We never sell your Submissions, and we do not allow third-party AI vendors to train on them.
5.1 Transactional messages. Messages necessary to process your application — for example, the one-time verification code we text to confirm your number, application-status updates, completion reminders, interview invitations, job offers, and shift confirmations — are sent by SMS and/or email as part of the service you requested when you applied. These are sent regardless of your marketing preferences because your application cannot be processed without them.
5.2 Consent to contact and recruiting outreach. When you apply you agree, by ticking the consent box on the application form, that we may call and text you about your application and about new shifts, roles, and opportunities you did not specifically apply for. The box is unchecked by default and must be ticked to submit an application, because we cannot move an application forward without being able to reach you. Messages and calls may be sent using automated technology, including an automatic telephone dialing system, and may include prerecorded or artificial-voice messages. Your consent is not a condition of purchasing any goods or services, and you can withdraw it at any time (Section 5.4); if you withdraw it after applying, we continue by email where you have given us an address.
5.3 Two-way messaging. You may reply to our SMS messages, and recruiters may correspond with you by SMS, MMS, or WhatsApp. The content of those conversations becomes part of your candidate file.
5.4 Opting out. Message and data rates may apply; message frequency varies. Reply STOP to any text message to stop texts to that number, HELP for help, or email support@premierstaff.com. Replying STOP stops our text messages to that number, including application messages, until you reply START; where you have given us an email address, we can continue by email.
5.5 Email tracking. Our email provider uses standard open- and click-tracking (a small tracking image and rewritten links) so we can tell whether our messages are reaching you. This is described further in the Privacy Policy.
5.6 Communication Terms. Our Candidate Communication Terms set out in full the text-message, telephone, and email terms, the consent statement shown on the application form, and how we keep consent records. They are incorporated into these Terms by reference and control where they are more specific.
We use software, including artificial-intelligence tools, to help our recruiters work through applications efficiently. Specifically:
The AI does not make hiring or placement decisions. It is a tool that helps guide our recruiters and streamline qualification based on your answers and skill sets, so a recruiter can identify good fits. A human recruiter reviews your application before any decision is made about advancing, placing, or declining your candidacy — there is no automated rejection, automated advancement, or score threshold that decides an outcome on its own. AI-generated scores are one input among others, and recruiters may weigh or disregard them.
The Privacy Policy's "Automated Processing and AI" section describes this processing in more detail, including jurisdiction-specific notices where they apply.
You represent, warrant, and agree that:
We may suspend or close applications that violate this section.
Submitting an application, completing a video interview, and receiving an AI score do not guarantee an interview outcome, placement, shift, job offer, or employment or engagement of any kind. Placement depends on Client demand, your qualifications and availability, scheduling, eligibility requirements, and other factors. Applying through the Platform does not create an employment or other work relationship between you and Premier Staff or any Client, and nothing in these Terms guarantees any minimum amount of work or compensation. If you are offered work, the terms of that engagement will be set out in a separate agreement.
The Platform — including its software, design, text, graphics, logos, and trademarks — is owned by Premier Staff or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Platform solely to apply for and manage your candidacy. You may not copy, modify, distribute, sell, or lease any part of the Platform, and you may not use our trademarks without our prior written permission. Nothing in this section limits your ownership of your own Submissions (Section 4.3).
The Platform and all evaluation features are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and without any warranty regarding the accuracy, reliability, or predictive value of transcripts, AI-generated scores, or other analysis. We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
To the maximum extent permitted by law:
Carve-outs. Nothing in these Terms limits or excludes liability for (a) gross negligence, fraud, or willful misconduct; (b) death or personal injury caused by negligence where such limitation is prohibited; or (c) any other liability, or any statutory right or remedy, that cannot be limited or waived under applicable law. Some jurisdictions do not allow the limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify and hold Premier Staff harmless from third-party claims, losses, and expenses (including reasonable attorneys' fees) to the extent arising from (a) your breach of your representations in Sections 2 and 7, (b) content in your Submissions that infringes or violates another person's rights, or (c) your violation of law in connection with your use of the Platform. This indemnity is intentionally limited to matters within your control and does not apply to claims arising from our own acts or omissions.
Please read this section carefully. It affects your rights, including your right to file a lawsuit in court and to have a jury trial.
13.1 Informal resolution first. Before starting arbitration, you and we each agree to try to resolve any dispute informally: the complaining party will send the other a written notice describing the dispute and the relief sought (to us: the contact address in Section 17; to you: the email on your application), and the parties will attempt in good faith to resolve it within 60 days. Arbitration may be started only after that period ends.
13.2 Agreement to arbitrate. Except as provided in Sections 13.3 and 13.6, you and Premier Staff agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or your use of the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The Federal Arbitration Act governs the interpretation and enforcement of this Section 13. The arbitrator (not a court) will decide all disputes about the interpretation, applicability, enforceability, or formation of this arbitration agreement, except that a court will decide disputes about the enforceability of the class-action waiver in Section 13.4.
13.3 Small-claims carve-out. Either party may instead bring an individual claim in small-claims court if it qualifies there, and either party may seek injunctive relief in court for infringement or misuse of intellectual property or unauthorized access to the Platform.
13.4 Class-action waiver. You and we each agree that disputes will be brought only on an individual basis, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court, and the remainder stays in arbitration.
13.5 Procedure, fees, and venue. Arbitration will be conducted by a single arbitrator, in English (or Spanish where required by law for Mexico-based candidates), by videoconference or documents-only where the AAA rules allow, or otherwise in the county where you live. Arbitration fees are allocated as provided by the AAA Consumer Arbitration Rules; we will pay the portion of filing and arbitrator fees those rules assign to the business. Each side bears its own attorneys' fees unless a statute provides otherwise. If 25 or more similar demands are filed by or with the assistance of coordinated counsel, the parties agree to AAA's mass-arbitration procedures, including batching and bellwether processes, to resolve them efficiently.
13.6 30-day right to opt out. You may reject this arbitration agreement — without affecting any other part of these Terms or your candidacy — by emailing us at the address in Section 17 within 30 days of first accepting these Terms, with your name, phone number, email used on your application, and a statement that you opt out of arbitration. If you opt out, disputes will be resolved in the courts identified in Section 14.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, except that Section 13 is governed by the Federal Arbitration Act. For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, except that either party may bring a qualifying claim in the small-claims court of the county where you live. Nothing in this section deprives you of mandatory consumer, labor, or data-protection protections of the place where you live that cannot be waived by contract — including, for candidates applying in Mexico, non-waivable protections of Mexican law.
We may update these Terms from time to time. When we do, we will update the version identifier and effective date at the top of this document. For material changes, we will provide advance notice (for example, by messaging the contact information on your application or posting a prominent notice on the Platform) and, where you have an application in progress or submit a new one, we will ask you to affirmatively accept the updated Terms through the same clickwrap mechanism — we do not rely on silence or continued browsing alone as acceptance of material changes. Changes are not retroactive: the version you accepted governs the Submissions and events that occurred while it was in effect, except as required by law.
You may stop using the Platform at any time, and you may request deletion of your information as described in the Privacy Policy. We may suspend or terminate your access to the Platform, or close your application, if you violate these Terms or for legitimate operational, legal, or security reasons. Sections that by their nature should survive — including Sections 4 (License, subject to Section 4.5), 8 (No Guarantee), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 13 (Dispute Resolution), 14 (Governing Law), and 17 (Contact) — survive termination.
